CBD is regulated by which agency under which law?

Despite the UK exiting the EU, the UK’s Food Standards Agency (FSA)’s position on CBD still aligns with the EU's position. This current position states that CBD is a novel food, and follows novel food regulation guidelines.

The FSA has set a deadline of March 31st, 2020, for market players to submit novel food applications. Only the products with validated or approved applications can stay on market. These products may including CBD oil, snacks, gummies, etc.

THC level requirement?

There are two different requirements on THC levels - one for hemp products and one for CBD extracts.

For hemp products, e.g. hemp oil, hemp seed for cultivation, the THC level has to be less than 0.2%

According to the Misuse of Drugs Act 1971, for CBD extracts, such as CBD distillate oil, CBD isolate, and products made with CBD extracts need to be THC free. THC free is defined in this act as being less than 0.02%.

However, most testing labs’ equipment has a limit of detection (LOD) of 0.05%. As long as the item has THC less that that threshold, it shows as non detectable (N/D), meaning it is deemed to THC free. While this is a limitation due to laboratory equipment, the official stance of THC levels being under 0.02% should still be observed.

Specific requirement for product label, source of material, import& export.

There are currently no restrictions on importing CBD products into the UK. The requirement is that the product must contain no THC, as defined above as having less than 0.02%. Again, however, there are many exceptions since most labs can only test to 0.05%.

If you are selling CBD products in the UK, make sure there are no medical claims made of the product. The product has to clearly list the CBD content and labeled as No THC.

On the other hand, CBD flowers are completely prohibited from being sold in the UK market, no matter the place of origin or THC content levels.

Market size estimate

The popularity and success of CBD products is due to its diverse product forms that are available in the market (tinctures, vape, edibles, topical, etc). Customers are able to find the most suitable product format to meet their needs and life styles. As estimated by market analysts, the UK’s CBD market could generate $1.3 billion USD (£1 billion) by 2024.
